Throughout this guide there have been references to the College's Designated Copyright Agent (DCA). An institution's DCA serves as the official point of contact for matters related to copyright infringement claims under the Digital Millennium Copyright Act (DMCA) in the United States. The agent is responsible for receiving notifications of claimed infringement from copyright holders and facilitating the institution's response, which may include taking down the material that is claimed to be infringing, forwarding the notice to the party who posted the material, or taking other appropriate steps.
The Designated Copyright Agent's responsibilities often include:
Receiving infringement claims and acting as the first point of contact for copyright holders who believe their intellectual property rights have been violated.
Evaluating the validity of the infringement claim in the context of the DMCA or other applicable copyright laws.
Initiating takedown procedures or other remedial actions if the claim is found to be valid.
If possible and applicable, notifying the person or entity responsible for posting the allegedly infringing material.
Maintaining records of all received DMCA notices, actions taken, and any counter-notices received.
